Hi team, I am intending to demolish my own house and reconstruct it. I have a neighbor (shop) who shares a common wall with my house. The width of common wall is almost 1.5 feet and I am legally bound to get half of that. The issue is while I am demolishing the common wall, the other half is also getting affected in the process and developing cracks. It has become extremely difficult to knock down the wall without affecting the other side. Inspite of several appeals and requests to my neighbor assuring him of repair in case of damage, he refuses to budge. No amount of persuasion seems working on him because of his adamant attitude. In this scenario, do I have an option to complain through Muncipal authorities (GHMC, Hyderabad) to force my neighbor to demolish the wall or entire structure (shop) as the construction is closed to 70 years of age. Citing reasons of safety and no proper maintenance can I file a complaint to bring down the shop? Please advice how do I proceed?

Hi, After redevelopment of our old building,I have received possession of my new shop from the builder in 2017. Maharashtra. The shop is duly registered under the Shop and Establishment Act. The society now is asking for the below, 1.I have let out my shop on rent with nature of business being a Hair Saloon. The society now objects to this nature of business. Is the society allowed to object to a legitimate business. 2 I am being asked to submit water meter permission issued to me by BMC and fire safety compliance report. Am I responsible for this or should the builder handover these documents to the Society when he transferred management to the Society in 2017? Is the society allowed to force me to get a new water meter connection from BMC when the society is charging me maintenance charges for my shop 50% more than the Flat owners in the society? Thank you in advance.

Flat transfer to more than one nominee If 2 persons are nominated by member and if both nominees wants their name to be mentioned in the Share Certificate on the death of member, what is the way out as only one can be admitted as member. Second nominee cannot even be appointed as Associate as the first named nominee himself does not have right, title and interest in the property as he is merely a trustee. As per MCS Act, as amended in 2014, to be an associate member he should be a part owner having right, title and interest in property, which will be absent in this case.

Hallo, I have got a gift deed from my father in the year 2007, and till then the property was on fathers name. Since 2007 I was holding the property through that giftdeed and rents on the property were handled by late mother (expired in 2011) and my father. I dint had to interfere. Once my mother expired, my father is behind the property and he wanted to revoke the giftdeed. I consulted a lawyer then, once I came to knew about his activities and everyone promised me that this is not possible as it is an unconditional giftdeed. But my father managed to revoke the giftdeed in 2016 October by bribing the MRO Officer with 5-6 Lakhs, by selling the car which I gifted him. I came to knew about this whole thing and flew to India (Jan 2017), called up my Sister and Brother In Laws, managed to register a sale deed of that property on wife's name. Me and my Father were executants (As the property bills were on my name). He accepted that it was bad on his part to make a this kind of move and apologized us for his behavior and promised that this would not happen again. Once I returned back here in Feb, he started digging back into the property. Saledeed original document, linked documents originals all with me. The Witnesses are also on my side. Should I be worried? Is there anything I can do (As he has revoked the giftdeed with out slightest intimation) Should I sell the property? Can you please suggest me what can be done to avoid unnecessary time and money behind rescuing the property which I Own. He is retired, getting Pension amount from my late Mothers employer (State govt), has lot of time and money wasting on these kind of things and wasting my time and money too. Thanks in advance Regards
