1. What are the circumstances which the Company Court takes into account before admitting/dismissing a Winding Up petition? How can a Company avoid admission of petition itself? 2. What exactly is the meaning of "commercial insolvency", which the Courts have taken into account while hearing the winding up petition post its admission. What is the financial data which courts look into while determining a company's commercial solvency/insolvency?

i had given a power of attorney regarding a property situated in indore to my relatives. after that i wanted to get it cancelled it was done by a pune-based lawyer and the entire cancellation was in marathi and i couldnt understand a word of it. but since the lawyer was a trusted family friend i relied on him to do it. of late i have heard talks that perhaps it was not cancelled. if it not cancelled i can be a great problem. i am placed in calcutta right now. my questions are 1. do i have to go to indore to get it cancelled again or can i do it from calcutta itself? 2. suppose the power of attorney is cancelled, will cancelling it again create any problem? 3. suppose there was any misuse done to the property between the period when i wanted to revoke the power of attorney and till the time it was actually revoked, what is my remedy?

Hi i have purchase adidas shoes but it got some defect so gave to the shop from where i purchased,the shoes is in warranty period..i have the receipt of purchase and receipt when i gave it to the shop for replacement..need advice planning to complaint in consumer court since neither the shop owner nor the adidas is responding since mailed them at care@adidas.com too but no respond

I deal in handloom products where i don't sell any tailored merchandise. My friend however has requested me to keep some of her start-up's promotional t-shirts in my store. though they are meant for promotional purpose she intends to sell it below the Cost price at a token sum. I presently don't have to pay any sales tax on handloom products, but I'm worried that if I keep such promotional t-shirts which are being "sold" at "token price" , it might get me under the sales tax department radar. Can you please clarify this?

If suppose I run a website, and I take the services of various authors to write articles for my website, now these authors want to sign a 1 or 2 page contract with me that I will acknowledge all their articles by by providing authorship credits to them on my website. in this case I am a bit confused if the required contract should be assignment of copyright (assignment agreement) or license agreement ? However I feel that an assignment agreement will be more suitable as I want a simpler contract. Can their be any contract simpler than assignment agreement ( as I have read on ipleaders blog that assignment agreement requires term of assigning copyright and territorial extent, which is something I don't intend to include in my contract) ?
