scope of using stamp paper

  • 1 Answer

Landlord had purchased a stamp paper for affidavit purpose later he used the same stamp paper for rent deed. Can he do so? Can a stamp paper be used for other purpose than it is purchased?

Answer 1

No, the landlord cannot use the stamp paper purchased for affidavit purpose for rent deed.    A stamp paper cannot be used for the purpose other for what it is issued because while issuing  the stamp paper, the purpose of its issue has to be informed to the issuing authority, moreover the  purpose of use is also mentioned on the stamp paper. Even if a person uses it for the purpose  other than for which it is issued, then the contract made on that stamp paper or any other  information which is provided on that stamp paper would be void (will not have any legality). It  would be equivalent to as if written on a blank sheet.
